This rental agreement covers all “Rental Equipment,” including but not limited to, snowshoes, propane fire pits, yoga mats, Bocce ball and other game sets, and French press coffee makers.

Acknowledgment of Risk
I, the undersigned, understand and acknowledge that using the Rental Equipment involves inherent risks, including but not limited to, the risk of personal injury or death, and damage to or loss of property. I fully understand that participation in activities using the Rental Equipment may result in injury or illness, including but not limited to bodily injury, fractures, strains, sprains, partial and/or total paralysis, death, or other ailments that could cause serious disability. These risks and hazards may be caused by the negligence of the participant or others, accidents, forces of nature, or other causes. I hereby freely assume all risks associated with the use of the Rental Equipment.

Release of Liability
In consideration of being allowed to rent and use the Rental Equipment from Jubilee Railroad, I hereby agree to release, waive, discharge, and covenant not to sue Jubilee Railroad, its owners, officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the releases or otherwise, while participating in any activity involving the Rental Equipment.

Indemnification
I further agree to indemnify and hold harmless Jubilee Railroad from any loss, liability, damage, or costs, including court costs and attorney fees, that may incur due to my participation in any activity involving the Rental Equipment, whether caused by negligence or otherwise.

Medical Considerations
I acknowledge that I am in good physical health and do not have any medical conditions that would prevent me from participating in any activity involving the Rental Equipment. I further understand that Jubilee Railroad does not provide medical insurance coverage and that I am responsible for my own medical expenses in the event of an injury.

Signature
I have read the above waiver and release of liability and understand that by signing it, I am giving up substantial rights, including my right to sue. I sign it voluntarily and without any inducement.
